GEORGIA, USA — Georgia's highest court upheld the decision to dismiss a lawsuit against the creation of the City of Mableton in Cobb County on Tuesday. The ruling comes months after the lawsuit was dismissed by a lower court in April.
Over 800 residents signed a petition against the rezoning request, the second time these neighborhoods banded together to fight a rezoning request in the area.
Although the 68-unit gated community includes a few estate-sized lots up to 4.3 acres, 11 acre-size parcels and 10 building sites of .60 of an acre, residents mainly opposed the 30 townhomes in five clusters of six attached, three-story units.
